Apostilling an FBI Background Check for Michigan Residents

Unlike state documents, federal documents like FBI background checks require a different authentication process. Discover the specific steps Michigan residents must take to secure a federal apostille for international use.

When preparing to teach English abroad, apply for foreign residency, or pursue international employment, one of the most frequently requested documents is a criminal history summary, commonly known as an FBI background check. For residents of Michigan, it is critical to understand that authenticating this specific document involves a completely different workflow than apostilling a state-issued document like a birth certificate or a business contract.

The fundamental distinction lies in jurisdiction. The Michigan Secretary of State's Office of the Great Seal only has the authority to authenticate documents issued by Michigan state or county officials, or documents notarized by a commissioned Michigan Notary Public. Because an FBI background check is a federal document issued by a federal agency, the State of Michigan has no jurisdiction over it. Submitting an FBI background check to Lansing will result in an immediate rejection and lost time.

Instead, FBI background checks must be authenticated by the federal government. The proper authority for issuing an apostille on a federal document is the United States Department of State (USDOS) Office of Authentications, located in Washington, D.C. This means that Michigan residents must direct their applications to the nation's capital rather than their state capital, navigating a process that is often characterized by significantly longer processing times.

The first step is obtaining the background check itself directly from the FBI or an approved channeler. When requesting the document, it is highly advisable to specify that you need it for international use and require a signed, physical copy rather than just a digital PDF. While the US Department of State does process some digital FBI checks, having the physical, officially signed document often streamlines the authentication process and is preferred by many foreign governments.

Once you have the official FBI background check, you must complete the DS-4194 form (Request for Authentications Service). This form requires similar information to the state application, most importantly the country where the document will be used. You must then package the original FBI document, the completed DS-4194, and the required federal fee (currently $20.00 per document) and mail it to the Office of Authentications in Virginia (which handles the mail processing for the D.C. office).

It is crucial to be aware of the federal processing times, which are historically much longer than state processing times. While a Michigan apostille might take a few weeks, a federal apostille from the US Department of State can take several weeks to several months, depending on their current backlog. Because there is no expedited federal service available for general public requests, Michigan residents must plan far in advance when an FBI background check apostille is required for their international endeavors.
